Validity of sales conditions
The terms of sale apply to the purchase of goods and services from the e-kalastus.ee online store between the buyer (hereinafter referred to as the Consumer) and the company E-Kalastus OÜ (hereinafter referred to as the Online Store).
In addition to these terms and conditions, the legal relationships arising from the purchase of products from the online store are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.
The online store reserves the right to make changes to the sales conditions. The mentioned changes are reflected on the website e-kalastus.ee
Price information
All prices in the online store are in euros.
For purchases, the cost of transport is added to the price according to the delivery method chosen by the Consumer.
All prices displayed in the e-kalastus.ee online store are valid only in the e-kalastus.ee online store.
Product prices and availability may change without notice. In this case, E-Kalastus OÜ reserves the right to cancel the sale and return the money to the buyer's current account within a reasonably necessary time.
E-Kalastus e-shop reserves the right to cancel the sale if any of the following problems have occurred with the Goods:
A mistake when entering the price or a technical error in the system (for example, if a rod costing EUR 200 is on sale for EUR 20, it is an obvious error. Or if the product is priced at 0 in the e-shop. Consequently, it is an error or technical error and the product is not included for sale at this price.
The prices are valid from the order completion until the payment deadline of the completed order expires 3 calendar days after the order completion.
If the order is placed before the terms of sale or prices are changed, the conditions valid at the time of placing the order will apply.
The online store reserves the right to make changes in sales prices. The mentioned changes are reflected on the website e-kalastus.ee.
When delivering goods with non-standard dimensions, the transport prices may differ from the usual ones.
E-Kalastus OÜ is the responsible processor of personal data, E-Kalastus OÜ transfers the personal data necessary for making payments to the authorized processor Montonio Finance OÜ
Forming the order
Add all desired products to cart. You can view the products in the shopping cart by clicking on the shopping cart icon in the bottom right corner.
A sidebar will open and you can make the following choices from there.
View the shopping cart - go to the shopping cart page. On the shopping cart page, you can get an overview of the order or change the content of your order if you wish. You can proceed from the shopping cart page to the "Pay" page.
Payment page - If you are not a registered customer, fill in all required address data fields on the page for smooth delivery of the shipment.
The registered customer has already filled in these fields during the registration process. On the page, you can also choose a separate "invoice address" and "delivery address" by adding a check mark
in the "send to another address" box. This option allows you to add a “shipping address” and the previously filled one remains the billing address. The item is always sent to the delivery address, not the billing address.
For final confirmation, choose a payment method, this can also be done later, put a check mark in the sales conditions box and press "Submit Order"
After that, you will be redirected to the bank you have previously selected, or all the options will be shown to you again. After the usual procedures in the bank, the order is displayed
confirmation with everything contained therein, and the same information will also be sent to the email you entered. Fill in the data and the cells on the order confirmation page carefully, because the speedy and trouble-free delivery of your purchased products and the subsequent resolution of disputes and claims depend on the accuracy and correctness of the information provided. The online store is not responsible for errors or delays in the delivery of goods if the information provided by the Consumer is incorrect.
Wish basket. The shopping cart is an easy tool for choosing the products you like and placing an order. When the product is added to the wish basket, the product is not automatically moved to the shopping basket, but the products must be moved from the wish basket to the shopping basket later. A very convenient way to plan purchases, calculate prices and add reminders to products.

Via a bank link
After placing the order, click on the link of the desired bank, which will direct you to the selected online bank: Swedbank, SEB, LHV, Luminor, Citadele or COOP Pank. Enter your user ID and passwords and enter Internet Banking.
In the Internet bank, you can see the already completed payment order, which contains the amount due for payment for the products purchased from e-kalastus.ee. Check the details and confirm the payment order.
With an invoice
You can pay for purchases by bank transfer and receive the goods at the address of your choice.

We offer the possibility to purchase goods in installments from Montonio.
Delivery times
Orders placed in the online store are handled on business days ER 09:00 - 17:00. Depending on the carrier and the location of the customer (customer), the delivery time within Estonia is 1-3 working days, outside Estonia (EU) according to the delivery time given by the carrier(s). Rest of the world, please contact us in advance to specify the delivery at epood(at)e-kalastus.ee
In the case of ordered goods, upon agreement with the customer, the delivery time may be longer.
Entry into force of the sales contract
With the contract for the sale of goods, the Online Store undertakes to hand over to the Consumer the existing Goods, which are manufactured or acquired by the Online Store in the future, and to enable the transfer of ownership to the Consumer, while the Consumer undertakes to pay the Online Store the amount shown on the invoice for the Goods and to accept the Goods.
Orders that have not been paid for will be canceled after 3 calendar days have passed since the order was placed.
The sales contract enters into force after the payment made by the Consumer has been received to the bank account of the Webshop (E-Kalastus OÜ).
Delivery
After the sales contract enters into force, the Webshop completes the order and hands it over to the company's logistics partners for delivery. The delivery terms shown on the E-kalastus.ee website are valid from the moment the order amount is received in the Webshop's bank account. In order to deliver without delays, you must be diligent and provide true and valid data when entering the delivery data when placing the order. The Online Store is not responsible for the delay in the delivery of the goods if the goods have been handed over to the logistics partners on time, but the delivery delay is due to circumstances that the Online Store could not influence or foresee.
Goods are sent to the following countries: Estonia. The shipping costs of the goods are borne by the buyer, and the corresponding price information is displayed next to the shipping method.
Right of return
After receiving the order, the Consumer has the right to withdraw from the contract concluded in the e-shop within 14 calendar days without giving a reason (according to VÚS § 53 paragraph 4, the Consumer cannot withdraw from the contract: for things that have been made taking into account the Consumer's personal needs; for things and services that have been ordered , made or performed according to the conditions provided by the consumer; for things that cannot be returned due to their nature - which are perishable or whose use-by date has passed; for things that are magazines or other periodical publications).
If the condition of the item subject to return (including the retail packaging) deteriorates, the Consumer is responsible for the decrease in value due to the use of the item, if he has used the item in a way other than what is necessary to make sure of the nature, properties and functioning of the item. In order to make sure of the nature, properties and functioning of the item, the Consumer should handle and use the item only as he would normally be allowed to do in the store.
In order to return the goods, a statement of withdrawal from the purchase of the goods must be submitted, the form of which can be found FROM HERE, and send it to Turu 47/2, 50106 Tartu, no later than 14 calendar days after receiving the goods.
The consumer must return the goods within 14 calendar days following the submission of the application or provide proof that he has handed over the goods to the logistics company within the aforementioned period. When returning goods, the return cost is borne by the consumer.
The customer does not have to return the goods through the logistics company if the online store has agreed to pick up the goods themselves.
Upon receipt of the withdrawal statement and the goods, the online store shall return to the consumer immediately, but no later than 14 calendar days later, all fees received from the consumer under the contract.
Force Majeure
1) The Online Store is not responsible for damages caused to the Customer or delays in the delivery of the goods if the damage or delay in the delivery of the goods is due to circumstances that the Online Store could not influence or foresee.
Processing of personal data
By entering data on the Online Store page and with the corresponding confirmation, the Consumer grants the Online Store the right to collect and process the Consumer's personal data (name, contact phone number, delivery and/or home address of the package, e-mail address) and to transmit personal data to the logistics partner for the delivery of the goods.
The online store has the right to use the Consumer's home or location address, telephone and e-mail address to transmit notifications and information to the Consumer.
The consumer has the right to prohibit the collection and use of his personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the goods.
The use of electronic personal data for direct mailings takes place only if the Consumer has given consent for this on the e-kalastus.ee page.
Encrypted data communication with banks when paying for purchases ensures the security of the Consumer's personal bank credentials, and the Online Store does not have any access to them.
Procedure for submitting claims
The online store is responsible for the non-compliance of the goods sold to the Consumer with the contract conditions or defects that appear within two years from the handing over of the goods to the Consumer.
In the event of a defect in the product, please stop using the product immediately and notify the Online Store FROM HERE
Repair or replacement of defective goods shall be mutually agreed upon by the Online Store and the Consumer.
The online store is not responsible for defects in the product due to the Consumer's fault, which have arisen as a result of improper storage of the product or non-intended use of the product.

A claim regarding the discovery of non-compliance or defects of the product must be submitted within two months from the discovery of the non-compliance or defect of the product.
All claims are reviewed and the Consumer is contacted as soon as possible, but no later than within 14 calendar days from the receipt of the claim.
The Consumer has the right to demand a reduction in the purchase price of the Online Store or to terminate the contract and to demand a refund for the goods, if the Consumer's claim is justified and the Online Store is unable to repair or replace the goods, the repair or replacement of the goods fails, the Online Store has not eliminated the defect in the goods within a reasonable time, the consumer has been unreasonable inconveniences.
